How many of you are playing GTA San Andreas? What do you feel about this:

Rockstar & Take Two Sued [July 27, 2005, 8:10 pm EDT] - 60 Comments
Gamemaker Sued Over Hidden Sex in GTA (thanks Mike Martinez) reports a New York woman has filed suit against Take-Two Interactive over the adult content that turns out to be hidden within the game that she bought for her 14-year-old grandson (in spite of the game's 17+ rating). Here's the latest on better living though litigation:

Florence Cohen, 85, of New York, said in the lawsuit filed in U.S. District Court in Manhattan that the game's manufacturer, Rockstar Games, and its parent company, New York-based Take Two Interactive Software Inc., engaged in false, misleading and deceptive practices.

She sought unspecified damages on behalf of herself and all consumers nationwide, saying the company should give up its profits from the game for what amounted to false advertising, consumer deception and unfair business practices.

What are you guys' opinions on this?

I think the sex scenes were probably put in and then forgotten about. No doubt one programmer went to another "Look what I just made!!". But given the code cannot be accessed in the normal course of events I suspect either it was forgotten about or they assumed no-one would find it (silly assumption given the nature of hackers and their ability to find hidden code) - was a mistake but nothing malicious.

I don't, however, think the woman has the right to sue, I think she's just been the first one to get the law suit in ahead of all the other money grabbers. The fact that she bought this game for her son, given its violent content, implies that either she thinks her son is ready for more mature games or that she has little idea what she's buying for her kid.

Given the kids age, it wouldn't surprise me if he'd seen a billion porn sites already anyway - its probably only because this made the news that she found out about this.

Of course rockstar will be found guilty and she'll be awarded at least $3 trillion, which will subsequently be reduced on appeal to about $20.51, of which her lawyer will get $15.99.

Just another stupid lawsuit.

She shouldn't have bought the game in the first place for her 14 yr old grandson if she thought that would be inappropriate.

My question is, how exactly does one "unlock" the code? don't you have to know how to get to it in order to unlock it? I wouldn't imagine that it is something easily stumbled upon, seeing as how the game has been out for almost a year? (I think a year?)

I hate having to card people trying to buy M rated games, but it is like a $10,000 fine per game if I sell it to someone under 17. This is something that, to my knowledge, is rather strictly enforced in Best Buy's ( I know someone who got fired for not carding a 27 yr old guy-was a "secret" shopper testing to see if we card everyone). I don't know how other stores do it, but I imagine with such a hefty fine, it isn't something that is ignored, and if you buy it online, you have to have a credit card, meaning you are 18.. true?

As such, this lady shouldn't be upset that her grandson "found" this sex scene, from what I have seen of it, the girl still has her tank top on, a thong, and the guy appears fully dressed. There is nothing really "explicit" other than the gestures, noises, and such. I have also seen the modded version wherein the girls clothing is editted out, but I think the ingame version is with the belly baring shirt, correct me if I am wrong, seeing as how I don't have the game and can't actually test it, just watch other people show me what's up.

This game is about shooting, running over, beating people up, right? So, it is ok to sell the game for these purposes, but heaven forbid if you include a quick non-explicit sex scene. People might be a little upset! Beat them hookers, kill the cops, but please, whatever you do, don't include a very hard to get to non-explicit sex scene.

Grandma should first realize the reason for a ratings system before she tries to work around it. There's a ratings system for a reason, the ignorant dips. Just how large and specific does the ESRB label have to be before people start actually reading it?

As Greebo said, "Just another stupid lawsuit."

She's probably going to win, if for no other reason than the fact that games get an "M" or "AO" rating for explicit sexual content, and Take Two was responsible for putting that content in the game. Whether they forgot or didn't know it was in there is irrelevant, the game got the rating based only on the violence and that's the basis for most people to decide whether kids can buy it (or whether stores will sell it).

I think they just raised the rating to AO, and for that many stores cannot sell the game. The only real thing it does is raise the age from 17 to 18, a friggin year, but now you really have to go to the web to purchase. Thank Mrs. Clinton for this.

I think the grandmother should be sued and thrown in jail for buying the game for her 14 year old grandson. She might as well sue the maker for the violence and language

Certainly think it's a waste of Government resources to invetigate this - it's a case of an accident or deliberate deception. But no - in they come, jumping on a bandwagon in order to look like the experts they aren't.

Our government amuses me sometimes. Mrs Clinton, I have lost all respect for you, and even though I am a Democrat...I will not be voting for you ever!!!!!
My friend, who works at Best Buy, told me that they had to pull all of the games(GTA), this cost their store 10,000 in potential sales. Our economy is bad, the government dosnen't realize they are only hurting it more!!!!! #alien
